Job Description
To determine the strategy for the Legal Department and the Human Capital Department. Provide input into the strategic direction of the NEF and its Subsidiaries as well as provide leadership in the development for the continuous evaluation of short and long-term strategic objectives. The General Counsel plays a significant role in developing relationships with key external third parties and assisting with raising third party funds for the organisation. Work with departmental leadership and key stakeholders across the business in overseeing and ensuring legal compliance across the business, maintaining the business’s integrity both internally and externally (reputational risk).
Legal Department- Oversee the provision of high quality legal counsel to fund management division and to other support departments.
- Ensure turnaround times from approval to disbursement are met.
- Manage clients in litigation and maximise collections from litigation and collection processes.
- Manage the legal budget and maximise impact from expenditure.
- Fulfil the role of Chairperson on internal committees as decided in terms of the Delegation of Authority Matrix.
- Ensure that legal support is provided to the portfolio departments.
- Act as an expert in providing guidance and support with restructures and turnarounds.
- Be well acquainted with various laws including BBBEE laws, FAIS, FICA, and the PFMA.
- Assist in management and monitoring of distressed clients working with relevant divisions.
- Develop portfolio reporting framework for litigation matters and report to the relevant forums.
- Oversee legal compliance matters and provide guidance to the legal compliance team.
- Assist the Marketing and Communications department with approval of assigned matters.
- Stay abreast of relevant legal developments and ensure that all relevant developments affecting the NEF are brought to the attention of the Executive Committee and other relevant structures.
- Oversee the management of the Human Capital Department.
- Develop/update the Human Capital Strategy.
- Ensure that the Human Capital strategy is aligned to the organisation’s strategy.
- Ensure that the Human Capital department provides an enabling environment for employees.
- Champion the employee needs at a strategic level.
- Ensure that the organisation is optimally resourced subject to available resources.
- Oversee the activities of the Human Capital and Remuneration Committee.
- Ensure there are up to date processes to manage performance and disciplinary matters.
- The General Counsel is a member of the Executive Committee and must participate competently in all activities involving the Executive.
- Invitee to Board meetings and board subcommittee meetings.
- Establish a working relationship with the DTIC CFO and GCFO as well as other key DFI stakeholders.
- Perform tasks as assigned by the CEO.
- Ensure performance contracts of all divisional staff are completed by deadline.
- Conduct performance reviews of all staff based on timelines.
- Provide leadership to the division.
- Ensure optimal and strategic resourcing including proper succession planning.
- Deal with complaints and parliamentary queries/assist in responding to queries.
- Resolve all audit findings for units timeously.
- Master’s degree an advantage.
- Admitted attorney.
- Minimum 10 years relevant experience.
- Experience in successfully handling commercial law matters, litigation matters, human resources matters, compliance and regulatory matters.
- High level of integrity and dependability with a strong sense of urgency and results-orientation.
- Ability to strategize and solve problems.
- Strong leadership and organizational skills.
- Proven and successful experience creating departmental priorities that align strategic direction of the legal department and the overall business objectives.

We’re seeking an experienced and business-minded lawyer to join our legal team. This individual will be instrumental in driving legal strategy across the organization while serving as a trusted partner to senior leadership and business unit leaders. How you’ll make an impact:
- Legal Strategy & Business Partnership:
- Support the Chief Legal Officer/General Counsel in providing strategic legal guidance across the organization. Offer practical legal solutions that align with the company’s goals in a fast-paced, consumer financial environment.
- HR & Employment Law Support:
- Advise on employment-related matters including performance management, workplace investigations, terminations, internal policy development, and compliance with federal and state labor laws. Act as a legal partner to the HR team in day-to-day and strategic matters.
- Vendor & Contract Management:
- Draft, review, and negotiate a wide variety of commercial contracts with a focus on vendor agreements, technology contracts, and service arrangements. Assist with the development of templates, negotiation standards, and best practices for contract efficiency and risk mitigation.
- Consumer Privacy
- Knowledge of domestic (federal and state) and international consumer privacy protections including, but not limited to, GLBA and GDPR.
- Ensuring the company’s compliance with various privacy laws and regulations, such as GLBA, GDPR, CCPA, and others relevant to the company's operations.
- Providing legal guidance on privacy-related matters to various functional teams within the company, including product development, marketing, and information security.
- Providing legal support to cross-functional teams that identify, assess, and mitigate privacy risks associated with the company's products, services, and data processing activities.
- Intellectual Property
- Inventory, manage, register and monitor the company’s intellectual property including federal and state protected trademarks and service marks.
- Cross-Functional Legal Support:
- Collaborate with teams across the business—including Operations, Finance, Product, and Compliance—to identify and address legal risks, support transactions, and ensure adherence to applicable laws and company policies.
- Regulatory Experience:
- Support project-based legal work, regulatory interpretations, or external communications. Help the company stay current with evolving laws and industry regulations. Regularly review and update policies and procedures designed to keep the company and its operations in compliance with federal and state consumer financial protection laws and regulations.
- Juris Doctor (JD) from an ABA-accredited law school.
- Minimum of 8 years of experience post-law school, with preference given to those how have 2–3 years of in-house legal counsel experience or the equivalent (seconded lawyer, for example).
- Experience in consumer financial services or similar regulated industry (non-banking).
- Demonstrated experience working across HR/legal domains and supporting the HR function.
- Strong understanding of vendor management and contract negotiation best practices.
- Excellent interpersonal and communication skills with proven ability to present to senior leaders and board members.
- Knowledge of HTML and IronClad, a plus.
- Able to work independently and lead cross-functional legal projects.
